Legal Battle Erupts Over Controversial Delhi NCR Car Ban: Unmasking the 'Car Bandi Scam

In a dramatic turn of events, Advocate Mukesh Kulthia has taken center stage in the Gurgaon court, launching a criminal case against government officials and high-ranking IAS officers from the Union Transport Ministry. The focal point of this legal showdown? The contentious 10-15 year old car ban rule in Delhi NCR, which Kulthia labels the 'Car Bandi Scam.'


At the heart of this legal tussle is the argument that this ban flagrantly violates the amended Motor Vehicles Act. The 2019, 2021, and 2021 revisions to the Act clearly extend the lifespan of diesel and petrol cars to 15 years, with an optional renewal for an additional 5 years. Kulthia passionately contends that the ban on older vehicles runs counter to the very essence of the amended Motor Vehicles Act, causing immense bewilderment among car owners.



Adding to the intrigue is the dissonance between the ban and the continued issuance of registration certificates for diesel and petrol vehicles, both valid for 15 years, as well as the collection of road taxes over this same period.


Kulthia's crusade extends to asserting that there exists no legal foundation for the prohibition of 10-year-old diesel and 15-year-old petrol vehicles. He claims that this ban, allegedly rooted in misleading references to the National Green Tribunal (NGT) and Supreme Court orders, represents a departure from the country's amended laws.
